Space Host Agreement
Who this is between
This agreement is between you, and the business you sign for, and Livabit, Inc.. It covers any place you list in the Livabit space directory for other hosts to rent: a farm, studio, kitchen, garden, hall or room.
You are an independent business. This agreement does not make you our employee, partner or agent.
Your space in the directory
You will describe your space accurately: what it is, how many people it holds, what comes with it, when it is free and anything a host needs to know before using it. You will tell us when any of that changes.
You give us permission to show your space's name, description and photos in the directory and in our marketing. You confirm you have the right to share every photo you send us, and to rent the space out.
We decide whether a space is published. We do not print your phone number, email or street address in the directory.
Requests, prices and payment
Hosts ask for a space through us. We introduce you, and you agree the dates, times and use with them. You may say no to any request.
The price for each rental, and our share of it, are agreed in writing before the rental is confirmed. The renting host pays us, and we pay you the agreed amount, less our share, by bank transfer after the rental.
If a rental is cancelled, what is refunded and what you are paid follow what was agreed in writing for that rental.
Your space and its safety
You are responsible for your space: its condition, safety, access and parking, its equipment and anything left there, and following the laws, permits, licences and rules that apply to it, including any limit on who may use it and how.
You will give the renting host the access you agreed, tell them about any hazards and house rules, and keep the space reasonably safe for the use you agreed.
You can ask anyone to leave who breaks your rules or puts people or the space at risk.
Insurance
You will carry property and liability insurance that covers your space while it is rented, and send us a certificate when we ask. You will tell us before that cover lapses or is reduced. We may take your space out of the directory while you are not covered.
Release of Livabit
We do not own, inspect, manage or control your space, and we do not supervise what renting hosts do there. You release Livabit, Inc. and its owners, staff and contractors from any claim you have, now or later, for injury, death, loss or damage to you, your staff or your property that arises from your space or from a rental, including damage caused by a renting host or their guests.
You will repay us for any claim, loss or cost, including reasonable legal fees, brought by a renting host, their guests or anyone else and arising from the condition of your space.
This section does not cover anything caused by our own gross negligence or intentional wrongdoing, or anything else the law does not allow to be released. Any claim you have about damage to your space is against the host who rented it.
Changes and ending this agreement
Either of us can end this agreement at any time by telling the other in writing. Rentals already confirmed should go ahead unless it is unsafe.
We may update this agreement. We will email you before an important change and ask you to sign the new version. If you do not agree, you can end this agreement.
The release and repayment terms continue after this agreement ends, for anything that happened while it was in force.
Governing law and signing
This agreement is governed by the laws of the State of California. Typing your name counts as signing it by hand, and binds the business you sign for.
You sign this when it applies to you. We keep a copy of what you signed and the date.
