Farm Crawl Visitor Waiver
The risks
Farms are working places. Visiting one carries risks that careful hosts cannot remove. These include: animals that kick, bite, peck, scratch or carry germs; uneven ground, mud, holes, slopes and steps; ponds, ditches, troughs and water; fences, gates, machinery, vehicles and tools; thorns, plants that sting or cause allergies, insects and bees; sun, heat and weather; food, drink and allergens; and driving between farms.
These risks can cause injury, illness, permanent disability or death, and can damage property. They are real, and no one can fully control them.
On the day
You agree to follow each farm's rules and instructions, stay in the areas you are shown, wash your hands after touching animals, and keep children with you and under your supervision at all times.
Each farm can refuse entry or ask anyone to leave who ignores its rules or puts people, animals or crops at risk.
You are responsible for driving between farms safely and lawfully.
Release of claims
In return for taking part, you release, and agree not to sue, each farm you visit, Livabit, Inc., the Eco Agritourism Development Fund, and their owners, staff, volunteers and contractors, for any claim arising from your visit, including claims caused by ordinary negligence.
This release binds you and anyone who might make a claim on your behalf, including your family, your estate and your heirs.
It does not release anyone from liability for gross negligence, recklessness, intentional harm, or anything else the law does not allow to be released. If any part of this section cannot be enforced, the rest still applies.
Children and others in your car
If you bring children under 18, you confirm that you are their parent or legal guardian, or have their parent's or guardian's permission, and you accept this waiver for them as well as for yourself. Where the law limits how far a parent can give up a child's own claims, that limit applies.
Other adults in your car must agree to this waiver too. You will show it to them before the visit and bring only adults who agree.
Medical treatment
If you or a child with you is injured and cannot consent, you authorise the farm to call for emergency help, and you accept responsibility for the cost of treatment and transport.
