Farm Crawl Host Agreement
Who this is between
This agreement is between your farm and Livabit, Inc. and the Eco Agritourism Development Fund, a nonprofit that runs the San Diego Farm Crawl. "We" and "us" mean both of them.
Your farm is an independent business. This agreement does not make you our employee, partner or agent.
Hosting visitors
On the crawl days you agree to host, you open your farm to Farm Crawl members and the people in their car, at the times we agree with you.
You decide which parts of your farm visitors may enter, what they may do there, and when a visit ends. You will brief visitors on any rules and hazards when they arrive.
You can turn away or ask to leave anyone who ignores your rules or puts people, animals or crops at risk.
Your farm and its safety
You are responsible for your farm: its land, buildings, roads, parking, fences, ponds and water, animals, plants, crops, machinery, tools and chemicals, and for following the laws, permits and food safety rules that apply to it.
You will keep the areas visitors use reasonably safe, mark or fence off hazards, keep animals that could hurt someone away from visitors or under control, and keep machinery and chemicals out of reach.
If you sell or give visitors food or drink, you are responsible for it being safe and for any permit it needs.
Insurance
You will carry farm or general liability insurance that covers visitors on your property during crawl days, and send us a certificate when we ask.
You will tell us before that cover lapses or is reduced. We may take your farm off a crawl day while you are not covered.
Release of Livabit and the Fund
We do not own, inspect, manage or control your farm. You release Livabit, Inc., the Eco Agritourism Development Fund, and their owners, staff, volunteers and contractors from any claim you have, now or later, for injury, death, loss or damage to you, your family, your staff, your animals, your crops or your property that arises from your farm or from anything that happens or happened there, including before you joined the Farm Crawl.
You will repay us for any claim, loss or cost, including reasonable legal fees, brought by a visitor or anyone else and arising from the condition of your farm or from anything that happens there during a crawl day.
This section does not cover anything caused by our own gross negligence or intentional wrongdoing, or anything else the law does not allow to be released.
Your farm on the Farm Crawl
You give us permission to show your farm's name, description and photos on the Farm Crawl pages and in our marketing. You confirm you have the right to share every photo you send us.
Hosting is free for your farm. Anything you sell to visitors is yours to keep.
Changes and ending this agreement
Either of us can end this agreement at any time by telling the other in writing. Crawl days already announced should go ahead unless it is unsafe.
We may update this agreement. We will email you before an important change and ask you to sign the new version. If you do not agree, you can end this agreement.
The release and repayment terms continue after this agreement ends, for anything that happened while it was in force.
