Host Liability Waiver and Release

Who this protects

This waiver protects Livabit, Inc. and, for the San Diego Farm Crawl, the Eco Agritourism Development Fund, a nonprofit that runs it, together with their owners, staff, volunteers and contractors. "We" and "us" mean them. "You" means you and the business or farm you sign for.

Your own risk

You host classes, events and visits, and take part in Livabit and the Farm Crawl, at your own risk. Teaching, guiding, farming and opening your place to the public carry risks of injury, illness, loss and damage that no one can fully remove.

Release of claims

You release us from any claim you have, now or later, for injury, death, illness, loss or damage to you, your family, your staff, your animals, your crops, your equipment or your property that arises from your classes, events or visits, or from your work as a host, wherever they take place: your own premises, a park, a beach, a trail, a guest's home, a farm, or a space you rent through us.

This release binds you and anyone who might make a claim on your behalf, including your family, your estate and your heirs.

Your premises

If a class, event or visit takes place on land or in a building you own, rent or control, you are responsible for that place: its condition, its safety, its access and parking, its animals, plants, water, equipment and structures, and following the laws, permits and rules that apply to it.

We do not own, inspect, manage or control your premises. The release above covers anything that happens or happened there, including before you joined.

You will repay us for any claim, loss or cost, including reasonable legal fees, brought by a guest, a visitor or anyone else and arising from the condition of your premises or from anything that happens there in connection with a class, an event or a visit booked or promoted through us.

What this does not cover

This waiver does not cover anything caused by our own gross negligence or intentional wrongdoing, or anything else the law does not allow to be released. If any part of it cannot be enforced, the rest still applies.

Signing

This waiver is governed by the laws of the State of California. Typing your name counts as signing it by hand, and binds the business or farm you sign for. It continues for as long as you host with us, and afterwards for anything that happened while you did.
