Terms of Service
In plain English
Livabit, Inc. introduces you to independent operators and handles the booking and the payment. The operator runs the journey — they decide whether it goes ahead, and they are responsible for how it is run.
You can browse and keep a bucket list without paying anything. Money only changes hands when you buy a session, a pack or a subscription.
If something goes wrong, tell us. We would rather sort it out than argue about which clause applies.
This summary is here to be read, not to be relied on. The numbered clauses below are what actually binds — where the two seem to disagree, the clauses win, and we would like to know about it so we can fix the summary.
What we are, and what we are not
Livabit, Inc. operates a marketplace. We find, vet and list journeys run by independent operators, we take bookings and payments for them, and we introduce you to each other. We do not run the journeys ourselves.
Each operator is an independent business, not our employee or agent. They set their own dates, capacity, safety procedures and cancellation terms, they hold their own licences and insurance, and they are responsible for delivering what their listing describes.
Where we collect payment, we do so as the merchant of record for that transaction and pass the operator their share less our commission. That arrangement is between us and the operator and does not change who is responsible for the journey itself.
Your account
You sign in with an account you already have — Google, GitHub, Facebook or Instagram. We never see or store a password.
You must be at least 18 to hold an account. Anyone under 18 can take part in an journey, but an adult has to book it and sign for them.
Keep your sign-in secure and tell us promptly if you think somebody else has used it. You are responsible for what happens under your account until you do.
You can delete your account at any time. Doing so removes your profile and your bucket list. It does not remove records we are required to keep — a signed waiver, a payment record or an invoice — which are covered in the Privacy Policy.
Bookings, packs and subscriptions
A single session is one place on one departure. A pack is a number of sessions bought up front and used over the window the listing states. A subscription grants a number of sessions each billing period and continues until you cancel.
Buying a pack or a subscription buys the sessions, not the dates. Dates are arranged with the operator afterwards and are subject to their availability, weather, minimum numbers and anything else their listing says.
Unused sessions in a pack lapse at the end of the window shown when you bought it. Unused sessions in a subscription period carry over only where the listing says they do.
Prices, availability and terms are as shown on the listing at the moment you buy. We may change a listing at any time; a change never alters what you have already paid for.
Taking part
Many of these journeys are physical, and some carry real risk. Before you book, read the listing and be honest with yourself and the operator about fitness, medical conditions, journey and — where it applies — the ability to swim.
You must sign the participant waiver before paying for an journey that requires one, and you must follow the operator's safety briefing and instructions on the day.
An operator may refuse or end participation, without refund, if somebody is unfit to take part safely, is under the influence of alcohol or drugs, or ignores safety instructions. That is their call to make and we will back it.
Cancellation and refunds
Cancellation is covered by the Cancellation and Refund Policy, which forms part of these terms. In short: the operator's stated notice period applies, and anything cancelled by the operator — including for weather or safety — is refunded in full or moved, at your choice.
Using the site
Do not use the site to break the law, to harass anybody, to scrape or resell our listings, or to try to reach data that is not yours. Do not upload anything you do not have the right to share.
If you publish a bucket list at a public link, you are choosing to make that page and the name and photo on it visible to anybody who has the link. You can take it down at any time and it comes down immediately.
The site, its text, its artwork and its structure are ours. Operators keep the rights to their own listing content and licence it to us to display.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Where you have rights as a consumer that cannot be signed away, these terms do not touch them.
Subject to that, Livabit, Inc. is not liable for the acts or omissions of an operator, and our total liability to you for anything arising out of the site or a booking is limited to the amount you paid us for the booking in question.
We do not promise the site will be uninterrupted or error-free, and we are not liable for indirect or consequential loss — a missed connection, a lost day, a disappointed weekend.
Changes to these terms
We may update these terms. Every version is dated and published, and the version you agreed to is recorded against your account.
If a change materially affects your rights, we will ask you to accept the new version before you carry on using your account, and we will say plainly what changed. Continuing to use the site after a minor change means you accept it.
Governing law
These terms are governed by the laws of the State of California, and the courts of the State of California have exclusive jurisdiction — except that either of us may bring a claim in small claims court where it qualifies.
Questions about any of this go to hello@livabit.co, and we answer within one business day.
You accept this when you create an account, and again if a material change is published. The version you accepted and the date are recorded against your account.
